How to adopt a stepchild (Part I)

Adopting a stepchild in Nebraska can seem confusing and complicated, but it does not have to be. Finding an experienced adoption attorney is the first step to starting the process of adopting your stepchild in Nebraska.

An experienced adoption attorney is necessary to start the process because of some of the complex issues that can come up in adoptions. At the very least, the adoption attorney can advise you on whether your case can proceed with the stepparent adoption at this time. Here are some factors that must always be present before a stepparent adoption process can begin:

1- Marriage: In Nebraska, the stepparent must be married to the custodial biological parent (the parent that the child lives with).

2- Residence: the child to be adopted must have resided with the stepparent for at least six months.

3- The absent biological parent must be willing to consent to the adoption, or must have abandoned the child for at least six months, or must have had his/her rights terminated, or must have relinquished their rights to the child already, or must be incapable of consenting (deceased). In the event that the absent biological parent is unwilling to consent to the adoption, your adoption attorney can guide you on the next steps to take.
